Terms and Conditions of Sale

Terms: All orders are cash in advance with adequate time for the check to clear. Or a cashier check will make it possible for the material to be shipped or picked up immediately. These terms will stand firm unless other arrangements have been approved by Glen Flora Farms, Inc. Credit will be considered after a firm becomes an established customer.

Established customer may request a credit application but should allow at least thirty (30) days for processing.

The following terms apply to those who have established credit with us:
1. All credit invoices are due within thirty (30) days of purchase date.
2. A late payment charge of 1.5% per month on the past due balance will be assessed on any overdue account.
3. If collection is required, Buyer also agrees to pay reasonable attorney's fees and other costs incurred at collection.

Prices: All prices are subject to change without notice

Orders are accepted only on the following conditions:
1. Any order may be canceled or delayed without liability to seller.
2. Orders are accepted subject to availability of stock at time of delivery.
3. All orders are subject to current prices at time of delivery.

We welcome advance orders and tagging, however we do require a 25% deposit for all material held for more than one week.

Claims: If any nursery stock proves untrue to description or variety name under which it is sold, we will, upon proper proof, replace such stock or refund the original amount paid. We give no warranty, expressed or implied, as to the productiveness or life of the nursery stock we sell and will not be responsible for the result secured on transplanting. We shall in no case be liable for any sum greater than the amount originally received for said stock. Claims made for any cause must be made promptly on receipt of stock. We will not entertain claims after goods have been accepted or when written notice is not made within 48 hours of receipt of stock.

Delivery Claims: Shortages and damages enroute must be claimed at time of delivery and noted in full detail on our delivery document. Buyer acknowledges that any person who signs the delivery document is authorized to sign it.

Notice: Orders are accepted on condition that they may be voided or delayed without liability to seller for delay or failure to deliver caused by crop failure, inclement weather, drought, hail, flood, fire, frost, strikes, errors in count, or other causes beyond our control. It is understood that all orders accepted are subject to availability of stock at time of delivery and that all orders are confirmed and subject to prices stated in price list current at the time of delivery.
